These Terms of Service ("Terms") govern your use of the Baby Mimo app ("the App"). By using the App, you agree to these Terms. If you do not agree, do not use the App.
1. Overview
Baby Mimo is a mobile application that helps parents and caregivers track their baby's milestones, moments, growth, and memories. The App stores data on your device and optionally syncs via Apple's iCloud service.
2. Eligibility
- You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account.
- The App is intended for use by parents and guardians. It is not intended for use by children.
3. Account
- You sign in using Apple's Sign in with Apple service. You are responsible for maintaining the security of your Apple ID.
- You are responsible for all activity that occurs under your account.
- You may delete your account at any time through the App's Settings.
4. Subscriptions & Payments
4.1 Free Tier
You may use the App with limited functionality at no cost. The free tier allows you to create up to 10 moments.
4.2 Premium Subscription
Premium access unlocks unlimited moments, photos, videos, and family sharing. Two plans are available:
- Monthly: $6.99 per month
- Yearly: $69.99 per year
Prices may change. Current pricing is always displayed in the App before purchase.
4.3 Free Trial
New subscribers may be eligible for a one-week free trial. Trial eligibility is determined by Apple and limited to one trial per Apple ID.
4.4 Billing & Renewal
- Subscriptions are billed through your Apple ID account via the App Store.
- Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current period.
- Your account will be charged for renewal within 24 hours prior to the end of the current period.
4.5 Cancellation
- You can cancel your subscription at any time through your Apple ID settings (Settings → Apple ID → Subscriptions).
- Cancellation takes effect at the end of the current billing period. You retain access until then.
- We do not provide refunds for partial billing periods. Refund requests must be directed to Apple.
4.6 Price Changes
If we change subscription prices, we will notify you in advance. Continued use after the price change takes effect constitutes acceptance. You may cancel before the new price applies.
4.7 Postcard Purchases
You may purchase physical postcards featuring your baby's moments as a one-time purchase ($2.99 per postcard). Postcard orders are non-refundable once submitted for printing. Postcards are printed and mailed by our fulfillment partner, Lob. Delivery is estimated at 5–10 business days within the US.
5. Your Content
5.1 Ownership
You retain ownership of all content you create in the App, including photos, videos, notes, and baby profile information ("Your Content").
5.2 License to Us
By using the App, you grant us a limited license to store, process, and transmit Your Content solely for the purpose of providing and improving the App's functionality (e.g., syncing across devices, generating milestone videos, displaying thumbnails, printing and mailing postcards). We do not use Your Content for any other purpose.
5.3 Your Responsibilities
You are responsible for:
- The accuracy of information you enter
- Ensuring you have the right to upload any photos or videos
- Keeping your data backed up (we recommend enabling iCloud backup)
5.4 Deletion of Content
- When you delete a moment, it is soft-deleted (hidden from the app) and permanently removed after 30 days. This delay ensures deletions sync reliably across all your devices and shared family members.
- When you remove a photo or video from a moment, the media file follows the same 30-day soft-deletion process.
- Deleting a baby profile permanently removes all associated moments, media, growth data, and postcards.
- Postcards that have already been printed and mailed cannot be recalled or deleted from the postal system.
5.5 Prohibited Content
You agree not to upload content that:
- Violates any law or regulation
- Infringes on the rights of others
- Contains malware or harmful code
6. Family Sharing
6.1 Inviting Members
You may invite family members to access a baby profile. You control the access level:
- Parent: Can view and add moments
- Caregiver: Can view and add media
- Viewer: Can view only
6.2 Your Responsibility as Owner
As the profile owner, you are responsible for choosing who to invite, managing access levels, and revoking access when appropriate.
6.3 Shared Access
Family members with shared access through your subscription may use premium features for the shared baby profile, even without their own subscription. This access depends on your subscription remaining active.
7. iCloud & Data Sync
- The App uses Apple's iCloud (CloudKit) to sync data across your devices and enable family sharing.
- Synced data is stored in your iCloud account and counts toward your iCloud storage quota.
- iCloud sync is subject to Apple's iCloud Terms of Service and Privacy Policy.
- We do not control Apple's iCloud infrastructure, availability, or data handling.
8. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose
- Attempt to reverse-engineer, decompile, or disassemble the App
- Interfere with or disrupt the App's functionality
- Use the App to collect data about other users without their consent
- Share your account credentials with others
9. Intellectual Property
- The App, its design, code, and branding are owned by us and protected by intellectual property laws.
- These Terms do not grant you any rights to our trademarks, logos, or branding.
- Milestone templates, categories, and app content are our intellectual property.
10. Disclaimer of Warranties
The app is provided "as is" and "as available" without warranties of any kind, express or implied.
We do not warrant that the App will be uninterrupted, error-free, or secure; that data will never be lost; or that the App will meet all your requirements.
The App is not a medical tool. Milestone tracking and growth measurements are for informational purposes only. Always consult a qualified healthcare professional for medical advice about your child's development.
11. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, arising from your use of the app.
Our total liability for any claim arising from the App shall not exceed the amount you paid for the App in the 12 months preceding the claim.
12. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the App, your violation of these Terms, or your violation of any rights of another person.
13. Termination
- You may stop using the App at any time by deleting it from your device and canceling any active subscription.
- We may suspend or terminate your access if you violate these Terms.
- Upon termination, your right to use the App ceases. Data stored locally on your device remains until you delete the App. Data in iCloud is managed through your iCloud account settings.
14. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes through the App or by updating the "Last Updated" date. Continued use of the App after changes take effect constitutes acceptance.
15. Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions.
